Terms and Conditions

These Terms and Conditions ("Terms") are an agreement between You and XEO Consistent Inc., a Wyoming corporation ("XEO Consistent Inc.", "We", "Us" or "Our"), which operates Image Fx at https://img-fx.com (the "Service"). They apply to every visitor and user of the Service. Our Privacy Policy and Refund Policy form part of these Terms. By creating an account, buying a plan or credits, or otherwise using the Service, You agree to these Terms. If You do not agree, do not use the Service.

1. Eligibility and Your account

You must be at least 18 years old to use the Service. We do not allow anyone under 18 to create an account or use the Service.
You sign in with Google or with a one-time email link. Keep access to that email account secure: You are responsible for everything done through Your account.
One person, one account. Do not create accounts to collect extra free credits, share an account outside Your own use, or resell access to the Service.
If You use the Service for a company or other organization, You confirm that You are allowed to accept these Terms on its behalf.

2. The Service and credits

Image Fx lets You create and edit images and videos with AI models, apply effects, and use free tools. Many features run on models provided by third parties. We may add, change or remove models and features at any time.

Credits. Most generations cost credits. The cost is shown on the button before You generate. Credits are a licence to use the Service, not money: they have no cash value, cannot be transferred or sold, and can only be used on Image Fx.
Free credits. New accounts receive sign-up credits, and You can collect more through the daily check-in, up to the limit shown in the product. Free credits can be changed or withdrawn at any time.
Subscription credits. Monthly plans add their credits at the start of each billing month. Yearly plans add a full year of credits at the start of the yearly term. Unused subscription credits do not carry over: when the plan renews, Your subscription credit balance is reset to the new allowance. Subscription credits are meant to be used while the subscription is active.
Credit packs. Credits bought as a one-time pack do not expire while Your account is open.
Failed generations. If a generation fails, the credits for it are returned to Your balance automatically.

3. Subscriptions, payment and cancellation

Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the price shown when You subscribed, until You cancel. By subscribing You authorize Us and Our payment partners to charge Your payment method for each renewal.
Cancelling. You can cancel at any time from the billing option in Your account menu, where Your payment method supports it, or by emailing [email protected] from Your account email. Cancelling stops the next renewal; You keep Your plan and its credits until the end of the period You already paid for.
Payment partners. Payments are handled by third-party payment processors and resellers, some of which act as the merchant of record and appear on Your statement. We never see or store Your full card number.
Prices and taxes. Prices are shown on the pricing page and may include or add applicable taxes. We may change prices for future billing periods; We will tell You before a price change applies to Your subscription, and You can cancel before it takes effect.

4. Refunds

You can get a full refund within 7 days of the first payment of a subscription, or of a credit pack purchase, if You have used no more than 20 credits from it. Renewals are not refundable, so cancel before the renewal date if You do not want to continue. The full rules and how to ask are in Our Refund Policy.

Users in the EU, EEA and UK: credits and generations are digital content supplied straight away. By buying and then using credits, You ask Us to start supplying them during the 14-day withdrawal period and acknowledge that You lose the statutory right of withdrawal once supply has begun. The 7-day refund in Our Refund Policy still applies.

5. Your content and what You create

Your inputs. You keep all rights You have in the prompts, images, videos and other material You submit ("Inputs"). You give Us a worldwide, non-exclusive, royalty-free licence to host, copy, process and transmit Inputs and Outputs only as needed to run, secure and improve the Service for You, including sending them to the model providers that fulfil Your request. This licence ends when You delete the content or Your account, except for copies We must keep by law or for safety records.
Outputs. As between You and Us, You own the images and videos the Service generates for You ("Outputs"), to the extent the law allows. We assign to You any rights We have in them. Outputs are private to Your account by default; We do not publish them in a public gallery.
Commercial use. Outputs You create while You have an active paid subscription, or with purchased credits, may be used for personal and commercial purposes, with no attribution required. Outputs created on the Free plan are for personal, non-commercial use only and may carry a watermark. Upgrading later does not change the licence of Outputs You created on the Free plan.
No guarantees about Outputs. AI output can be inaccurate, unexpected, or similar to content created for other users. Copyright protection for AI-generated material varies by country and may not be available. You are responsible for checking an Output before You publish or rely on it, and for making sure Your use does not infringe trademarks, copyrights, likeness or other rights of others.
Model providers. Some models are provided by third parties such as Google, OpenAI, ByteDance, Black Forest Labs, Alibaba (Qwen), MiniMax and xAI. You must also follow any usage policy those providers apply to their models.
Model training. We do not use Your Inputs or Outputs to train Our own AI models.

6. Acceptable use

Use the Service only for lawful purposes and in line with these Terms. You are responsible for Your Inputs and for anything You generate, download, share or publish with the Service.

Photos of real people. Only upload photos of yourself, or of people who have agreed to their photo being used in this way. This applies to every face, portrait, swap, kiss, hug and similar effect.

Prohibited content

You must not use the Service, and must not attempt or instruct the Service, to generate, upload, transmit, store, share, or distribute any of the following:

NSFW, pornographic, or sexually explicit content. This includes any sexually explicit or sexually suggestive imagery, video, or text, in particular any visual output produced by Our image generators, video generators, LoRA models, or any other media-generation feature of the Service. Nudity, sexual acts, fetish content, and content whose primary purpose is sexual arousal are strictly prohibited, regardless of artistic, satirical, educational, or comedic framing.
Child sexual abuse material (CSAM) or any sexual or sexualized depiction of a minor, or of any person who could reasonably be interpreted as a minor. This is a zero-tolerance prohibition; any such use will result in immediate account termination and reporting to the appropriate authorities, including, where applicable, the National Center for Missing & Exploited Children (NCMEC).
Non-consensual intimate imagery, sexual deepfakes, or unauthorized likeness use. You may not generate sexual or sexualized content depicting any real, identifiable person without that person's verifiable consent, and You may not generate visual likenesses of real artists, celebrities, public figures, or other identifiable individuals without their consent.
Face-swap, deepfake, or face-manipulation content intended to impersonate, defame, deceive, or otherwise misrepresent a real, identifiable person without their verifiable consent.
Violent, graphic, or shocking content, including content that glorifies, incites, or instructs real-world violence, terrorism, self-harm, suicide, eating disorders, or cruelty to animals.
Hateful or discriminatory content targeting any individual or group on the basis of race, ethnicity, national origin, religion, caste, disability, gender, gender identity, sexual orientation, age, veteran status, or any other protected characteristic.
Harassment, bullying, doxxing, or threats directed at any individual or group.
Illegal content or activity, including content that violates applicable law, infringes intellectual-property, trademark, publicity, or privacy rights, facilitates fraud, evades sanctions, or promotes the sale of regulated goods or services.
Misleading or deceptive content, including content designed to spread disinformation, manipulate elections, impersonate brands or officials, or commit scams.
Malware, exploits, or content that compromises security, including content designed to phish credentials, distribute malicious code, or circumvent platform safeguards.

7. Safety checks and enforcement

Prompts and uploads are checked automatically, and some outputs are checked after generation. Requests that look prohibited are blocked. We may remove content, limit features, or suspend or close accounts that break these Terms, and We report child sexual abuse material to the relevant authorities, including NCMEC.

8. Copyright complaints

If You believe content on the Service infringes Your copyright, email [email protected] with the subject "Copyright notice" and include: Your contact details; the work You say is infringed; where the material appears on the Service; a statement that You believe in good faith the use is not authorized; a statement, under penalty of perjury, that the notice is accurate and that You own or may act for the owner of the right; and Your physical or electronic signature. We respond to valid notices under the U.S. Digital Millennium Copyright Act and close the accounts of repeat infringers.

9. Third-party services and links

The Service relies on third parties (for example sign-in, payments, cloud storage and AI model providers) and may link to other websites. We are not responsible for third-party websites or services, which have their own terms and privacy policies.

10. Ending this agreement

You can stop using the Service at any time and ask Us to delete Your account by emailing [email protected]. Cancel any subscription first so You are not charged again.
We may suspend or close Your account if You break these Terms, if We must do so by law, or to protect users or the Service. Credits are lost when an account is closed for a breach.
If We close Your account without a breach on Your part, or shut down the Service, We will give You reasonable notice where We can and refund the unused part of any credit pack You bought.
Sections 5, 11, 12, 13, 14 and 16 continue after this agreement ends.

11. Disclaimer

The Service and all Outputs are provided "as is" and "as available". To the fullest extent the law allows, We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Service will be uninterrupted, error-free or secure, that any model will stay available, or that Outputs will be accurate, unique or fit for Your purpose.

12. Limitation of liability

To the fullest extent the law allows, XEO Consistent Inc. and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service. Our total liability for all claims related to the Service is limited to the greater of the amount You paid Us in the 12 months before the claim and US$100. Some places do not allow these limits, so they may not all apply to You.

13. Indemnity

You agree to defend and indemnify XEO Consistent Inc. against third-party claims, losses and reasonable legal costs arising from Your Inputs, Your use of Outputs, or Your breach of these Terms or of anyone's rights.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Please contact Us first so We can try to solve any problem informally. Any dispute that is not solved within 30 days will be decided by the state or federal courts located in Wyoming, and You and We consent to their jurisdiction. If You are a consumer in the EU, EEA or UK, You also keep the protection of the mandatory laws of the country where You live and may bring a claim in its courts.

15. Changes to these Terms

We may update these Terms. We will change the "Last updated" date and, for material changes, tell account holders by email or in the product at least 14 days before the new Terms take effect. If You keep using the Service after that, You accept the new Terms; if You do not agree, stop using the Service and cancel Your subscription.

16. General

These Terms, with the Privacy Policy and Refund Policy, are the whole agreement between You and Us about the Service.
If any part is found unenforceable, the rest stays in effect. Not enforcing a right is not a waiver of it.
You may not transfer these Terms without Our consent. We may transfer them as part of a merger, acquisition or sale of assets.
These Terms are written in English. If a translation differs, the English version applies.
